BPK Nilai SKK Migas Bersalah Tunjuk Konsultan Asing Blok Masela

SKK Migas menyatakan, keputusan penunjukan langsung itu karena waktu untuk memutuskan skema pengembangan Blok Masela sangat mendesak.

Badan Pemeriksa Keuangan (BPK) menilai penunjukan konsultan independen oleh Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) untuk mengevaluasi pengembangan Blok Masela, tidak sesuai dengan aturan. Penilaian tersebut tercantum dalam hasil pemeriksaan Laporan Keuangan SKK Migas tahun 2015, yang disampaikan BPK kepada Dewan Perwakilan Rakyat (DPR) dan Presiden Joko Widodo pada pekan lalu.

Dalam pemeriksaannya, BPK menyoroti penunjukan langsung PT Synergy Energi (SE) untuk mengkaji konsep pengembangan Lapangan Abadi Blok Masela periode 27 November hingga 23 Desember 2015. Dalam pengerjaannya, Synergy menunjuk konsultan asing Poten and Partner (PP).

Penunjukan langsung Synergy itu berdasarkan proses seleksi tim counterpart, yang terdiri atas Menteri Energi dan Sumber Daya Mineral (ESDM), Dirjen Migas, dan Kepala SKK Migas selaku Tim Pengarah. Tim ini memutuskan kemitraan Synergy dan Poten sebagai konsultan.

Namun, BPK menemukan data yang berbeda. Berdasarkan proses seleksi yang dilakukan oleh Tim Counterpart tanggal 3 November 2015 tidak disebutkan bahwa Synergy turut diundang dan melakukan penawaran. Tim itu hanya mengundang enam konsultan internasional, antara lain WoodMackenzie, IHS, Black & Veatch, Fluor, Poten, serta DNV GL.

Berdasarkan pemeriksaan dokumen, terdapat tiga penawar yang mengikuti proses seleksi, yaitu Poten dengan penawaran US$ 249 ribu, DNV GL sebesar Rp 8,83 miliar, serta WoodMackenzie Rp 4,05 miliar. Meski tawarannya paling rendah, Poten belakangan menyertakan Synergy sebagai mitra lokal di Indonesia ketika proses seleksi sudah berjalan dan penawaran awal sudah dimasukkan. Selain itu, BPK menilai, penunjukan langsung tersebut tidak sesuai dengan ketentuan yang ada. "Penunjukan langsung dapat dilakukan dalam kondisi tertentu, seperti penanganan darurat, pertahanan negara, terbatasnya penyedia jasa, konsultan hukum atas gugatan pada pemerintah," tulis BPK dalam hasil pemeriksaannya.

BPK juga menilai, proses seleksi konsultan tersebut oleh Tim Counterpart tidak sesuai dengan Peraturan Presiden (Perpres) Nomor 54 Tahun 2010 jo. Perpres 4 Tahun 2015 tentang Pengadaan Barang dan Jasa Pemerintah. Pelimpahan pekerjaan utama oleh Synergy kepada subkontraktor, dalam hal ini Poten, juga dipersoalkan BPK.

Konsultan utama, yakni Synergy, hanya melakukan dukungan data dan analisis sebagian dari skenario alternatif pengembangan Lapangan Abadi. Sedangkan subkontraktor mendapat tugas utama memutuskan rekomendasi terbaik. Padahal, mengacu Perpres 4/2015, penyedia jasa dilarang melakukan subkontrak pekerjaan utama. Selain itu, keberadaan subkontraktor tidak memenuhi syarat terkait keikutsertaan perusahaan asing dalam pengadaan barang dan jasa.

Atas temuan tersebut, SKK Migas menyatakan, keputusan penunjukan langsung itu karena waktu untuk memutuskan skema pengembangan Blok Masela sangat mendesak. Jika melalui proses lelang normal membutuhkan waktu paling cepat 38 hari kerja, sedangkan hasil kajiannya sudah harus rampung paling lambat 28 Desember 2015.

Sekadar informasi, hasil kajian Poten merekomendasikan pengembangan Blok Masela menggunakan skema kilang pengolahan di laut (Floating LNG/FLNG) alias offshore. Hal ini diamini oleh SKK Migas dan Kementerian ESDM. Namun, belakangan, Presiden Joko Widodo memutuskan skema pengembangan Blok Masela di darat (onshore) . Hingga kini, pemerintah dan Inpex Corporation sebagai kontraktor Blok Masela masih menyusun rencana pengembangan blok kaya gas di Laut Arafura tersebut.
